I am sure you have heard the tag line, “Virginia is for lovers” haven’t you?

Well I am going to propose a change. Let us be honest with ourselves and chose a slogan that would actually be true.

Here is my humble suggestion: VIRGINIA IS FOR EMPLOYERS.

Now I like the sound of that, and, as an employment lawyer who represents only employees, I know it to be true.

True or false:

1. If you are fired, your non-compete is no longer binding under Va law?

FALSE.

2. If you refuse to sign a non-compete, you can be fired?

TRUE.

3. If you want to start your own business, you may be forbidden from doing so because of an agreement you signed 6 years ago?

TRUE.

4. If your company is sold, and you lose your job, you may still be bound by your non-compete?

TRUE.

Well employees, do not totally despair. Virginia may be for Employers, but you should know your options too. Dan and I are here to help you navigate our fair state’s legal system.

Maybe in a few years the bumper sticker will read, VIRGINIA IS FOR EMPLOYEES.
