There are a few tricks we like to share with our clients when it comes to employment litigation.

Best way to avoid litigation: Do NOT sign a Non-compete agreement.

Even that does not prevent all litigation as employees have other non-contractual duties they will sometimes breach.

Second best way to avoid litigation: Don’t breach your contract.

Again, that is even not a 100% way to avoid litigation. People sue for no reason and sometimes good reason, so playing by the rules of the contract is always good, but you can still get sued.

The best way to avoid litigation: Don’t be a jerk.

Seriously. People don’t spend their time and money suing unless (1) they are jerks; or (2) you were a jerk.

Be nice.
Don’t steal.
Be honest.
