Lauren wrote a great blog yesterday about the legal rights of the elderly in nursing homes.

In regard to legal rights, one of the frequent questions we hear is, ” Can they kick my dad out of his nursing home?” In Virginia, there is a specific law which answers the questions. Basically, a resident can ONLY by discharged or transferred out of the nursing home for one of the following reasons:

1. Nonpayment of charges.

2. If the nursing home cannot meet the resident’s medical needs.

3. If the resident is a danger to himself/herself or other residents.

4. With informed and voluntary consent of the resident or his/her legal representative.
