If something goes wrong during a surgery, or a patient is given the wrong medication, or has a terrible response to treatment, who is responsible?
Medicine is unfortunately, not an exact science. This means that mistakes are made, and sometimes problems simply occur. In Virginia, you have the right to file suit and seek compensation if and only if
(1) Your health care provider was negligent
AND
(2) their negligence caused you pain and suffering that you would not have suffered otherwise.
So, who is responsible for your pain and suffering related to medical care? Either
(1) The doctor is responsible; or
(2) You are responsible; or
(3) No one is responsible – it just happened and no one is to blame.
Now wait a minute, you may ask why a plaintiff’s attorney would ever say that the patient is responsible, but sometimes it is true. And sometimes, no one is to blame – after all, didn’t you Mom tell you that life is not always fair?
