As hard as it is to believe, surgeons and surgical teams sometimes leave stuff in their patients.

What kind of stuff?
Gauze
Sponges
Surgical tacks
needles

You name it. If it is involved in surgery, it has probably been accidentally left inside someone.

As you can imagine however, your body isn’t going to easily accept these foreign bodies, and complications occur – infection, sepsis, gangrene.

So what kind of potential case do you have if a physician has left something inside a patient in Virginia? Its called a foreign body case and under Virginia law, you only have 1 year from the date of discovery to file suit on a foreign body case.

This means, even if the foreign body is not yet causing you pain, you have to file suit. Even if it’s still in you and you are awaiting treatment, you have 1 year and only 1 year.

So, the moral of the story is, if you have a foreign body left in you post surgery in Virginia, call an attorney to investigate your case within 1 year of finding the problem.
