Let me tell you something. Pharmacy negligence happens all the time.

The wrong pills end up in the wrong bottle.
The wrong dose ends up being sent home.
Another person’s pills end up in your bag with your label.

We hear about these cases all the time.

We even know of a pharmacist sending a medication home with their patient / customer, despite a known allergy to the medication.

Now, I am not saying that pharmacists should be let off the hook for these egregious errors. I am however, advising clients, patients, Virginians, to be diligent.

1. READ THE LABEL – is that your name? Your medication?
2. LOOK AT THE PILLS – are those the same pills you have been taking for months? If not – don’t take them. Ask why they are different.

In order to be successful on a pharmacy negligence case, you must prove the following:

1. The pharmacist was negligent in giving you wrong meds / wrong dose / etc.

This can be the easy part to prove.

2. That the mistake, the wrong pill, wrong dose, caused you permanent injury or extensive pain and suffering AND no other medications, past medical conditions etc., caused these problems.

This is the hard part to prove. While taking the wrong medication or not getting your regular med. can cause you pain, these cases often are won or loss on the science or the pharmacology of it.
