The law in every state is different.
That is why attorneys are licensed in individual states, presumably, they know the laws of that state and are prepared to advise clients on that state’s unique laws.
Employment contracts are no different.
You may work in Tennessee for a North Carolina Company. Or maybe, you were hired in virginia, but quickly transferred to Maryland to serve clients there.
What law applies should you decide to leave and want to know whether your non compete agreement is enforceable?
Hopefully, the attorney who drafted said employment agreement for your employer, put a Choice of Law Provision, which states – What state law applies.
If not, well, then you may need to call an attorney in the state you work and ask them if your state law applies.
If your Choice of Law provision says Virginia – we can help.
If it doesn’t, then we probably can’t help.
