Sometimes we write about our cases, and clients. Today, I am writing to congratulate our colleagues Attorneys Fred Smith (Martinsville) and Anthony Russell (Roanoke) who spent last week in a medical malpractice trial against a Martinsville physician.
The only guarantee in a civil trial, is that everyone is exhausted by the end – the jury, the plaintiff, the defendant, the lawyers, probably even the judge. How the jury will rule is almost always a surprise, at least to one of the parties.
In this case, our colleagues fought hard for their client (the victim of malpractice) and the jury agreed awarding the victim $1,000,000 in damages.
In his closing argument, Mr. Smith correctly explained that it wasn’t up to the jury as to whether the victim needed the money, or how it would be spent. The question was, was damage caused by negligence, and if so, what amount of money makes up for the damage.
So to our friends Tony and Fred – we congratulate you. No one wants to file a medical malpractice case. No one wants to ask the jury for help. But sometimes you have to, and we are glad for the justice your client received.
