Here is another disturbing report from the American Association for Justice.
Russell Binning, a 93-year-old resident of the East Bank Center Nursing Home in Illinois, suffered from Alzheimer’s disease and used a wheelchair. While Binning was sitting near the front door of the home, a visitor wheeled him to the outside of the home and left him there unattended. Binning subsequently rolled down a hill in his wheelchair and fell into a ditch near the side of a road. He suffered fatal injuries in the fall. Binning is survived by his wife and two adult sons.
Mr. Binning’s wife and sons sued the home, alleging that it failed to (1) properly monitor and supervise Binning, (2) properly control activity near the home’s front entrance, and (3) warn others not to assist residents without permission. Suit also alleged that the defendant failed to ensure Binning’s safety and prevent him from exiting the facility.
My Question: Where was the nurse or aide who took Mr. Binnings outside the building?
