Is a pressure ulcer (bed sore) the result of neglect or negligent care?

Is malnutrition or dehydration the result of neglect or negligent care?
Often times.
We have folks call our office, upset, angry, or worried that their loved one has suffered or endured one of the above conditions at a Virginia nursing home. They will explain what the wound looks like, how the fall occurred, etc. and assume that such horrific events could not occur but for someone NOT doing their job.
It is difficult to explain, but not every pressure ulcer is caused by negligence. Not every fall is caused by neglect. Not every amputation is caused by medical mistakes. Sometimes, these things happen even in the best care. So it becomes our job to review the medical records at issue and determine if the conditions were caused by neglect, negligence, or just the body’s natural course.
And, if the records reflect the cause was neglect or negligence, we will certainly recommend further investigation possibly filing suit.
