Virginians, lend me your ears.
Your employer EXPECTS you to sign their non-compete.
Their attorneys (the folks drafting the agreements) have told them the agreements are only helpful if (1) EVERYONE SIGNS THEM and (2) THE AGREEMENTS ARE THE SAME.
So, what does this mean for you when you are asked to sign one?
Sadly, it means under Virginia law you have a few options.
1. SIGN
2. TRY TO NEGOTIATE – good luck
3. DON’T SIGN – and yes, they can fire you for that
Want to read a more indepth discussion on your options, and what happens if you do get stuck with one of these? Read an article I wrote on the very topic –
The only only way that Virginians can get rid of these, is by refusing to sign them.
I MEAN IT – what if a whole class of new employees refuses?
Do you think the employer will take the time to find replacements? Maybe… but maybe not!
