Well, to my friends in need of answers, let me be clear.
1. Is my non-compete agreement void if I am fired?
No. Not necessariliy. Depends on your specific contract.
2. Is my non-compete agreement void if my Employer loses a contract?
Doubtful – but again, depends on your contract.
3. Am I released from my non-compete agreement if the company is sold?
Maybe – I will have to see your contract to let you know.
Every contract is different and unique. Every employment contract case is also different – so these questions cannot be answered very simply. I would advise you to speak to an attorney who can help you understand what your rights and obligations are under your Virginia employment agreement or non-compete agreement.
Want to know the scary part? You are obligated to do things under Va. law that are not even in your contract – so before you make a big chance, you may want to seek some help as to what activities you are permitted to do.
