Get this question all the time:

Q: “I can compete right? I never signed a non-compete,” caller inquires.

A: I try to explain that yes, you may be able to compete, there are some things you can’t do by law, regardless of your employment contract.

Q: “Ugh – like what kind of stuff?”
(imagine client like the Dude in Big Lebowski – smart, but man of few words)

A: “Like, His Dudeness,  you can’t (1) compete while an employee; (2) use confidential or trade secret information; (3) say bad things or defame the business of your old company; (4) keep their stuff and copy it.”

Stated simply, just because you don’t have an actual employment agreement does NOT mean you can do whatever you want. It just doesn’t. You have be aware of the law in your state and act accordingly.
